$500 reservation deposit terms

These Terms of Sale govern the $500 reservation deposit you place through the Wahoo Pool & Landscape Construction Pty Ltd website (ABN 509 746 576 38, QBCC Licence 15247996). By completing checkout, you agree to these terms. These Terms of Sale do not constitute a building contract — the actual pool build is governed by a separate written contract you'll sign after our on-site assessment.

SECTION 1

What you are buying

The $500 you pay at checkout is a reservation deposit — it secures a build slot in our scheduling calendar. It is not a deposit on construction services. By placing this deposit, you are:

  • Confirming your serious interest in proceeding to a free on-site assessment;
  • Reserving priority placement in our build schedule;
  • Triggering our commitment to contact you within 1 business day to arrange the on-site visit;
  • Triggering our commitment to provide a fully itemised quote within 7 days of the on-site visit.

SECTION 2

What happens after you place the deposit

1. Within 1 business day: Mike (project manager) calls or emails you, by your preferred method.
2. Within 7 business days: We conduct the free on-site assessment at your property.
3. Within 7 days of the assessment: We send you a fully itemised written quote.
4. If you proceed: You sign a written build contract (separate from these Terms). Your $500 deposit is credited toward your contract.
5. If you decide not to proceed: Your $500 deposit is refunded in full to your original payment method, within 5 business days. See our Refund Policy.

SECTION 3

Pricing displayed at checkout

Prices on package pages are displayed in Australian Dollars (AUD) and include 10% GST. Each package page clearly explains what is included and what is not included (e.g., excavation, fencing, landscaping, electrical). The package price is not the total cost of your build — your itemised quote following the on-site assessment will cover all costs.

SECTION 4

Australian Consumer Law

Our services come with non-excludable consumer guarantees under the Australian Consumer Law. Nothing in these Terms of Sale operates to exclude, restrict, or modify those guarantees. See our Refund Policy for details on: major and minor failures of a service; your rights to refund, repair, or compensation; and how to escalate a dispute (QBCC, Office of Fair Trading Queensland).

Sections 5–8

  • 5. Payment processing

    Payments are processed via Shopify Payments and other payment providers, in accordance with their own terms. We do not store full credit card numbers. Refer to our Privacy Policy for details on how payment information is handled.

  • 6. Our right to decline

    We reserve the right to decline a deposit and refund it in full where, for any reason, we determine that we cannot deliver the requested package — e.g., if your property is outside our service area, or if site conditions identified during the assessment prevent us from delivering as configured. In such cases we'll explain why and refund within 5 business days.

  • 7. Changes to these Terms

    We may update these Terms of Sale from time to time. The "Last updated" date at the top of this page indicates when changes were made. The version of these Terms in effect at the time you place your deposit governs your purchase.

  • 8. Governing law

    These Terms of Sale are governed by the laws of Queensland, Australia, and disputes are subject to the non-exclusive jurisdiction of the courts of Queensland.
