Refund policy

This Refund Policy explains how Wahoo Pool & Landscape Construction Pty Ltd (ABN 509 746 576 38, QBCC Licence 15247996) ("Wahoo", "we", "us") handles deposits, refunds, cancellations, and consumer rights for pool construction services.

1. About our $500 reservation deposit

When you place a $500 reservation deposit through our website, you are securing a build slot in our calendar. This deposit is fully refundable until you sign a build contract with us. The deposit does not create a binding contract for the construction of a pool — it is a slot reservation.

2. When you can request a full refund of your $500 deposit

Your $500 deposit is fully refundable if:

  • You decide not to proceed at any time before signing a build contract with us;
  • Our on-site assessment reveals that we cannot deliver the package you have selected (e.g., unsuitable site access or ground conditions);
  • Our quote, after on-site assessment, exceeds your stated budget and you choose not to proceed;
  • We cannot offer a build slot within a timeframe acceptable to you.

3. After a build contract is signed

Once you sign a build contract with us, the terms of that contract govern progress payments, milestones, and any cancellation rights. Build contract terms are separate from this Refund Policy and will be discussed with you in detail before signing. Any progress payments under your build contract are governed by:

  • The terms set out in your written build contract;
  • The Domestic Building Contracts Act 2000 (Qld), which governs residential building contracts in Queensland;
  • The QBCC Insurance Scheme protections that apply to residential building work above the relevant threshold.

4. Variations and unforeseen site conditions

If, during construction, unforeseen ground or site conditions arise (e.g., rock, contaminated soil, unexpected utilities) that materially change the scope or cost of the build, we will:

  1. Stop work and document the issue in writing;
  2. Provide you with a written variation outlining additional cost or changed timeline;
  3. Wait for your written approval before proceeding.

You are never charged for variations without your written consent.

5. Australian Consumer Law — your rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. These include guarantees that our services will be:

  • Provided with due care and skill;
  • Fit for any specified purpose;
  • Provided within a reasonable time (where no time is specified);

If a service we provide fails to meet a consumer guarantee:

  • For a major failure, you are entitled to cancel your service contract with us and receive a refund for the unused portion, or to compensation for the difference in value of the services provided;
  • For other failures, you are entitled to have the problem rectified in a reasonable time, or, if this is not done, to cancel the contract and obtain a refund for the unused portion.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in our services.

6. Statutory warranties — building work

Beyond this Refund Policy, your build is covered by:

  • A 10-year structural warranty on the pool shell, as outlined in our Warranty & After-Care page;
  • Manufacturer warranties on Zodiac equipment (extended via our Titanium Dealer status);
  • Statutory warranties under the Domestic Building Contracts Act 2000 (Qld);
  • QBCC Home Warranty Insurance for residential building work above the threshold.

7. Refund methods and timeframes

All approved refunds are returned to your original payment method:

  • Credit/debit card: 3-5 business days after we initiate the refund;
  • Bank transfer / direct deposit: 1-3 business days;
  • Other: as agreed.

You will receive an email confirmation when the refund is processed.

8. Disputes

If you have a concern about a refund, deposit, or any aspect of our services, please contact us first — we are committed to resolving issues quickly and fairly. Most concerns are resolved within 7 days.

If we cannot resolve a dispute directly, you may escalate to:
