These Terms of Service ("Terms") govern your use of the Wahoo Pool & Landscape Construction Pty Ltd (ABN 509 746 576 38, QBCC Licence 15247996) ("Wahoo", "we", "us") website and online services. By using our website or placing a $500 reservation deposit, you agree to these Terms. These Terms do not replace the build contract you sign with us when you decide to proceed with a pool build — that contract has separate, more detailed terms governing the construction itself.
1. Who we are
Wahoo Pool & Landscape Construction Pty Ltd is a Queensland-based residential pool construction and landscaping company, licensed by the QBCC under licence number 15247996. We operate from Unit 3, 73-75 Steel Street, Capalaba QLD 4157, and primarily serve Greater Brisbane and South-East Queensland.
2. What you can do on our website
You may use our website to:
- Browse our pool packages and services;
- Read our build process, warranty, FAQ, and compliance information;
- Submit a Get a Quote form to request a free site assessment;
- Place a $500 reservation deposit to secure a build slot.
3. About the $500 reservation deposit
The $500 reservation deposit you place through our online checkout is a slot reservation, not a binding agreement to construct a pool. By placing the deposit, you are:
- Confirming your interest in proceeding to a free on-site assessment;
- Reserving a build slot in our scheduling calendar;
- Receiving an itemised quote within 7 days of the on-site assessment.

4. Pricing and quotes
Pricing displayed on our website is in Australian Dollars (AUD) and includes GST. Package prices represent the pool component of a build only. As clearly disclosed on each package page, the following are not included in the package price:
- Site preparation and excavation;
- Pool fencing and Pool Safety Certificate;
- Surrounding landscaping, paving, decking;
- Electrical connection and final commissioning.
You will receive a fully itemised quote, covering every cost, after our on-site assessment. We do not enter into a build contract without a written, itemised quote signed by both parties.
5. Site assessment
Once you place a deposit, we will arrange a free site assessment within 7 business days. During this visit, our project manager will inspect your block, ground conditions, access, and confirm the package fits your space. Following the visit, you will receive a written, itemised quote within 7 days.
6. Service area
We currently provide services within Queensland, Australia, with a primary focus on Greater Brisbane (Brisbane City, Logan, Moreton Bay, Redland, Ipswich, Gold Coast hinterland, and surrounding areas). If your property is outside this area, please contact us to discuss whether we can serve you.
7. Council approvals and regulatory compliance
All Wahoo pool builds comply with:
- The Building Act 1975 (Qld) and the Queensland Pool Safety Standard (MP 3.4);
- Local council development approval requirements (Brisbane City, Redland City, Logan City, Moreton Bay Regional, Gold Coast City, Ipswich City, Scenic Rim Regional);
- QBCC licensing and insurance requirements;
- Independent aquatic engineering sign-off on every steel reinforcement stage.
We handle the council development application on your behalf as part of the build contract.
8. Intellectual property
All content on our website — including text, images, design, logos, and the Wahoo Pool name — is owned by us or our licensors and is protected by Australian copyright and trademark law. You may not copy, reproduce, or distribute our content without our written permission. Project photographs of completed Wahoo builds remain our property; we may use these in marketing.
9. Use of website — what you must not do
You agree not to:
- Use our website for any unlawful purpose;
- Submit false information through our forms or checkout;
- Attempt to access, hack, or compromise our website;
- Scrape, copy, or republish our content without permission;
- Send automated requests or spam through our forms.
10. Third-party services and links
Our website integrates with third-party services (Shopify for hosting and payments, Klaviyo for email, Google for analytics, Judge.me for reviews, and others). Your use of these services is also subject to their own terms. We are not responsible for the content or practices of third-party websites linked from our site.
11. Disclaimer — website content
While we take care to ensure the accuracy of information on our website, we provide the website "as is". Build durations, capacity calculations, yard area recommendations, and other technical figures are guides — actual figures for your project will be confirmed in your written quote and build contract.
12. Limitation of liability
To the maximum extent permitted by law and subject always to the Australian Consumer Law:
- Our liability under these Terms is limited to the value of the services we have provided to you;
- We are not liable for indirect, consequential, or special losses arising from your use of our website (this exclusion does not apply to liability that cannot be excluded under Australian law);
- Where our services come with non-excludable consumer guarantees under the Australian Consumer Law, our liability for failing to comply is limited to (at our option) the supply of the services again or payment of the cost of having the services supplied again.
13. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies the application of the Australian Consumer Law or any other statutory rights you may have that cannot be excluded by law. Your rights under the Australian Consumer Law operate in addition to any rights you have under these Terms or your build contract.
14. Privacy
Our handling of your personal information is governed by our Privacy Policy.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when changes were made. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
16. Governing law and jurisdiction
These Terms are governed by the laws of Queensland, Australia. Any dispute arising from or in connection with these Terms or our website is subject to the non-exclusive jurisdiction of the courts of Queensland.
